The Protection of Women and Girls in Sports Act of 2025 (H.R. 28/S. 9)* passed in the House of Representatives on January 14, 2025, by a vote of 208-218.** By changing the definition of compliance under Title IX,*** this legislation stops any U.S. school, college, or university that receives federal financial assistance from allowing boys/men to participate in a girls or women’s athletic program, activity, or team. For the purposes of the legislation, it also defines boys and men as individuals whose reproductive biology and genetics were male at birth.
Boys and men will still be allowed to train with girls and women, but they are prohibited from taking a scholarship or team roster spot from any girl or woman. And the House version of the bill requires the Comptroller General to carry out a study to determine the potential harm done to girls/women in the past, then report back to the House Education Committee.
The Senate attempted to bring S. 9+ to the Floor in March 2025 under a procedural cloture motion that required 60 “Yea” votes before the final bill could be considered. The cloture motion only received 51 votes++ and failed, so S. 9 was not addressed for debate or a final vote on the Senate Floor.
President Trump did sign Executive Order (EO) 14201 (February 2025) “Keeping Men Out of Women’s Sports” and the NCAA has changed its rules related to women’s collegiate sports, in keeping with the EO. However, this issue should still be addressed in federal statute and to date, the Senate has blocked Congressional action.
